Terms and conditions

CHECK-IN & CHECK-OUT:
You may check in directly to your property with your access code. The access code will either allow access via an electronic lock on the door of your individual unit, or it will allow access to a lockbox that will contain your keys, which will be at or near the front door to your individual unit.  Your access code will be sent to you via email on the morning of your arrival, between 10 a.m. and 4 p.m. If you do not have access to your email on the day of your arrival, please call or text (251) 233-8232, after 10 a.m., to receive your code.

Check-In is after 4:00 p.m., on the date of your arrival
Check-Out is at 10:00 a.m., on the date of your departure

***Please adhere to the check-out time as our cleaning staff has limited time to prepare the property for the next guests.  Although rare, there could be a possibility that your individual unit will not be ready for check-in at 4 p.m.  We do our very best to meet this timeline, but during peak season we may need a little extra time to prepare your unit for arrival.***

If the door to your property is controlled by an electronic lock, your access code will expire at 10:00 a.m., on the date of your departure.

LOCKOUT POLICY:
It is the Guest’s responsibility to retain possession of the access code or keys provided. In the event a guest is locked out of a property, the guest should call (251) 233-8232. PLEASE BE AWARE THAT THERE IS A $50 SERVICE CALL CHARGE FOR A MEMBER OF OUR MANAGEMENT TEAM TO UNLOCK DOOR TO PROPERTY FOR LOST KEYS OR LOCK-OUT.  In the event that keys to the property are not returned upon checkout, guest will be charged $80 to rekey the lock to the property if access is controlled by a traditional key. If property is accessed by key card, there will be a $10 charge per key for key cards that are not returned after checkout.

NUMBER OF GUESTS/HOUSE PARTIES:
Guest agrees that the number of people occupying the property will not exceed the number stated in the property rules at any time for any reason. If the number of people occupying the property exceeds the number stated in the rules, the guest acknowledges that this could constitute a cause for immediate eviction and will result in loss of total rent and/or additional charges per guest. Occupants of premises shall not be the cause of any disturbance or offense to surrounding neighbors. The use of fireworks and/or firearms is strictly prohibited. House parties, keg parties, or any disruptive behavior will result in the guest vacating the property immediately without a refund.

AGE REQUIREMENTS/FALSE PRETENSES:
You must be 25 years of age with a valid photo I.D. or Driver’s License to rent this property, and you must occupy the property for the duration of the stay. Thank you for your cooperation in this matter. Violation of the age requirement constitutes a rental under false pretenses and is in violation of this Agreement. Guest will be asked to vacate the premises immediately without refund.

PARKING PASS:
The maximum number of cars allowed at the property at any one time is two, unless otherwise specified during booking. Parking passes must be purchased during booking of reservation or from the front desk upon arrival. Unless stated otherwise, the parking pass fee collected at time of booking is for one parking pass. If you need an additional pass, please contact us. If there was no parking pass fee collected at the time of booking, then you will need to purchase a pass from the on-site front-desk at your building. No parking of boat or jet ski trailers allowed on site, and NO RV’s allowed on site. At times, accommodations can be made for vehicles/trailers with advance planning. CANCELLATION POLICY:
Cancellations made prior to 30 days before the start of the rental contract will be refunded in full, minus the convenience fee. Cancellations made prior to 15 days before the start of the rental contract will entitled to a refund in the amount of 50% of the rent and fees, minus the convenience fee. Any cancellations made within 15 days of the start of the rental contract will NOT be entitled to a refund of the rent and fees. No Shows are subject to the entire rental rate and all fees collected or due, as stated in the rental agreement. Cancellation policy also applies to last minute bookings. No Exceptions to this policy. Trip insurance is highly recommended to protect your investment, as we are unable to make exceptions to our cancellation policy.

REFUNDS:
No refunds for early departures (fewer days than reserved). No refunds will be given for delayed arrival. No refunds or rescheduling will be made due to inclement weather. Neither Owner nor Island Rentals shall be liable for events beyond their control which may interfere with guest’s occupancy, including, but not limited to Acts of God, acts of governmental agencies, strikes, war, and inclement weather. NO REBATE OR REFUND will be offered in these circumstances. Rental for periods of inclement weather will not be refunded. However, if there is a Mandatory Evacuation ordered by local authorities due to a hurricane or tropical storm, all unused rents while the evacuation order is in effect will be refunded. If the unit is uninhabitable due to storm damage, all unused rents will be refunded. Although unlikely, in the event that your vacation rental is uninhabitable due to a maintenance emergency or any other reason that would affect the safety and soundness of the property, Island Rentals will make every effort to relocate your reservation to another property, if available.  If Island Rentals is unable to provide lodging, a full refund will be issued to the guest.  We strongly recommend trip insurance to protect your investment.

RETURNED CHECKS:
There will be a $50.00 service fee for all returned checks.

PET POLICY:
No pets are allowed. A pet or evidence of a pet will cause forfeiture of the entire rent and fees, including the damage deposit, and immediate tenant eviction. Penalty fees may be assessed to the guest in the event that a pet is discovered on property.  In addition to penalty fees, if evidence of a pet is discovered after check-out, guest will incur additional cleaning charges.

SMOKING:
Smoking is not permitted inside the property, in hallways, or on the balcony! Evidence of smoking in the unit (including the balcony) will cause forfeiture of the entire rent including deposit and immediate tenant eviction. If evidence of smoking in the property (including the balcony) is discovered before or after check-out, guest will incur additional cleaning charges.

ALCOHOL & ILLEGAL DRUGS:
Consumption of alcoholic beverages is limited to people of legal age. Illegal drug use is strictly prohibited and will result immediate eviction without refund, as well as notification of local police authorities.

LINENS/AMENITY SET UP:
Linens are provided, as well as a starter set of amenities that will typically last for the first 24 hours of your stay.  The amenity starter pack includes the following items: one dishwasher detergent packet, one miniature bottle of dishwashing liquid soap, one roll of paper towels, one trash can liner in each trash can, one packet of powder laundry detergent, one roll of toilet paper in each bathroom, one bath soap bar in each full bathroom, and one hand soap bar in each bathroom.  Each property is set up with four bath towels, four washcloths, two hand towels, and one bath mat, per full bathroom.  One hand towel is provided for each half bathroom. Sheets, pillowcases and quilts are provided for each bed in the property. If you would like to request extra linens for an additional fee prior to your arrival, please contact us to arrange.

LISTINGS & PRICING:
Information regarding condo listings is believed to be accurate, but cannot be guaranteed. We have made every effort to ensure that all of the information on our website is up-to-date and accurate. The possibility of errors and omissions exists. Our staff will be happy to confirm all information or answer any questions you may have prior to reserving a condo.

CLEANING/CHECK-OUT REQUIREMENTS:
Guest is required to leave the property in the same general condition as found upon arrival. Dishes should be clean and left in the dishwasher, if used during your stay. Island Rentals will clean the condo and clean all linens and towels upon your departure. If additional cleaning is required, a service charge will be charged to the credit card number on file, or the cost will be deducted from the damage deposit. Guest is responsible for all damage, abuse, excessive cleanup required, or loss caused by any member of the guest’s party to the property or its contents during occupancy. Island Rentals will inspect each condo after checkout to ensure it is left in good condition. Island Rentals will make the final determination of the necessity of any charges to the guest, if necessary. We will not be responsible for loss of money or valuables of any kind.

REPAIRS/SERVICE CALLS:
Island Rentals cannot guarantee against mechanical failure of heating, air conditioning, hot tubs, TV’s, DVD’s, or other appliances or systems. Please report any inoperative equipment to us immediately. Island Rentals will make every reasonable effort to have repairs completed quickly and efficiently, or may move you to another property, if available. Should a repair technician make a call to a rental property unit and find that the equipment is in working order, and the problem was due to the guest’s oversight or neglect, the charge for service will be at the guest’s expense. No refund or rent reductions will be made due to failure of the appliances and/or equipment. Guest understands and agrees that Island Rentals may enter the rental property at any reasonable time for the purpose of making any needed repairs.
RIGHT OF ENTRY:
Guest agrees that Island Rentals reserves the right to enter the condo at any time to investigate disturbances, check occupancy, check for damages, to make repairs, alterations or improvements thereto, as Island Rentals may deem appropriate. Prior notice will be given to the guest unless Island Rentals suspects that guest is violating property rules. It is possible that your rental may be listed for sale. If so, it is possible that your unit may be shown to potential buyers, with your permission.  You are not expected to clean or vacate the unit for the showing.

EVICTION:
A material breach of this contract by the guest, which, in the sole determination of Island Rentals, results in damage to the property, personal injury to the guest or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for immediate eviction. Violation of any of the rules contained in this contract will result in immediate eviction and forfeiture of rent.

INDEMNIFICATION AND HOLD HARMLESS:
Guest agrees to indemnify and hold harmless the owner of the property and Island Rentals for any liabilities, theft, damage, cost or expense whatsoever arising from, or related to, any claim or litigation, which may arise out of, or in connection with, guest’s use and occupancy of the property. This is including, but not limited to, any claim or liability for personal injury or death due to hot tub or pool usage, any other facility or recreation usage, or any other or damage or theft of property which is made, incurred or sustained by guest. The terms “Island Rentals” and “Owner” is used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest”, “You” and “Your”, as used in this Agreement, shall include guest’s heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during guest’s occupancy (without regard to whether such persons have authority under this Agreement to be at the property), where the context requires or permits.  Words in the singular number shall be construed to include plural; and words in the plural shall me construed to indicate the singular.

DISPUTES:
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Alabama, and shall be treated as though it were executed in the County of Baldwin County District Court, State of Alabama. Any action relating to this Agreement shall be instituted and prosecuted only in the Baldwin County District Court, in the State of Alabama. Guest specifically consents to such jurisdictions and to extraterritorial service of process.

Island Rentals reserves the right to refuse service to anyone.

All properties are leased without regard to race, color, religion, sex, handicap, familial status, national origin, sexual orientation or gender identity.

Due to liability issues, we are unable to provide prospective renters with keys to preview properties.

DAMAGES TO PROPERTY:
Guest agrees that if damage is caused to the property as a result of actions committed by Guest, visitors of Guest, or any person whom the Guest allows to be in the unit, that the Guest is liable for the cost of repair and restoration of the property, over and above any and all Refundable Damage Deposit funds or Property Damage Protection Insurance coverage, to the original state of the property at check-in. This applies to all damage—intentional or accidental.  NO FOOTWEAR ALLOWED THAT COULD DAMAGE FLOORING OR OTHER SURFACES (i.e.  cleats, golf spikes, stiletto heels, roller blades, etc.).

VIOLATING AGREEMENT:
If guest violates any of the conditions of this Agreement; Island Rentals may exercise the right to immediately evict guest. Guest shall vacate the Condo immediately and will forfeit all rents and fees, and, if necessary, will be responsible for any and all legal fees incurred in an attempt to enforce this Agreement or evict guest.

TRAVEL INSURANCE:
Guest Protect Travel Insurance (G-330CSA)
Vacation Rental Insurance has been made available with your reservation. Vacation Rental Insurance provides coverage for the loss of prepaid, non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. Trip Cancellation and Trip Interruption coverage is available for events such as a sickness or injury of yourself, family member or traveling companion; flight delays due to adverse weather; interruptions of road service; terrorist acts; and mandatory evacuations. The plan also includes other valuable coverages such as Medical and Dental, Baggage, and Emergency Assistance and Transportation in addition to useful services such as identity theft, concierge and 24/7/365 emergency assistance. We strongly recommend you purchase this valuable protection. Vacation Rental Damage Protection (G-20VRD)
As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of [Policy Limit]. Any damages that exceed [Policy Limit] or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of [Policy Limit]. Certain terms and conditions apply. Please contact [Company Name]directly if you do not wish to participate in this assignment.

I, the guest, have read this Agreement in its entirety and understand and agree to all statements in this Agreement.

Reservation Prices do not Include:

Expenses and items not mentioned, including, but not limited to: transportation, tips for personal services, meals, insurance, telephone calls and other items of a personal nature.

Responsibility:

  • Tenant hereby assumes all risk of damage to any and all personal property of Landlord and Tenant, including household furniture and goods during such use and occupancy.
  • Tenant hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord harmless from and indemnify Landlord against the same.

Use:

  • It is agreed that the Premises shall be used only for residential purposes, no animals and for no other purpose whatsoever.
  • Tenant in the possession, use and occupancy of the Premises agrees to observe and comply with all restrictions, laws and ordinances affecting the Premises or occupancy thereof.
  • Tenant further agrees that no use shall be made of the Premises, or acts done which will increase the existing rate of insurance upon the Premises, or will cause a cancellation of any insurance policy covering the Premises.
  • Smoking is not permitted in any residence. A $150 fee may be charged for ionization, if smoking in the property is detected.
